1. Pet Requirements
I represent that my pet meets all the following requirements:
a. Current on his/her required vaccinations
b. Answers to his/her name when called
c. Is on monthly heart-worm/flea and tick preventative medication
d. Has been in good health for the last 30 days
e. Is not aggressive, toy protective, or food aggressive
f. Is at least 8 weeks of age
2. Pet Illness/Veterinary Care
If a pet becomes ill or in need of medical attention, PawPals Lake Nona LLC and its providers will contact the Client immediately. The Client can then make medical decisions and facilitate medical payments directly with the veterinary clinic, if needed. In the event of a medical emergency where PawPals Lake Nona LLC is unable to contact the Client or their emergency contact directly to authorize care, this contract will be used to obtain medical care. Client agrees that in the event that any of their pets appear to be ill or injured, or is at significant risk of experiencing a medical problem while in the care of PawPals Lake Nona LLC Client hereby gives PawPals Lake Nona LLC and their pet sitters their express permission to transport any pet(s) to, and seek veterinary services from a veterinarian or veterinary clinic. Client gives permission for all pets listed to receive medical care at the veterinary clinic. Should the Client’s veterinary clinic of choice not be listed, be closed or unable to provide services, the Client agrees authorizes PawPals Lake Nona LLC and its pet sitters to seek service from another veterinarian, including an emergency veterinarian hospital.
3. Unsafe Pets
I certify that my dog is not aggressive, and I understand that aggressive dogs are not permitted to participate in services provided by PAWPALS. This contract permits PawPals Lake Nona LLC to use discretion to stop and end service at any time that Client’s pet(s) pose a danger to the safety and health of itself, other pets, other people orPawPals Lake Nona LLC sitters/walkers. If concerns prohibit the pet sitter from caring for the pet, PawPals Lake Nona LLC attempt to contact the Client to arrange alternative care. If the Client cannot be reached, the Client authorizes PawPals Lake Nona LLC to place the pet in a licensed kennel with all charges and fees arising to be the responsibility of the Client.
4. Injure To Client Animal(s) By Other Animal
PawPals Lake Nona LLC and its staff will not be responsible for any animal(s) that instigate fights with other animals or is injured by another animal while in PawPals Lake Nona LLC care. PawPals Lake Nona LLC will take all appropriate actions to ensure that Client’s animal(s) are not placed in the company of aggressive or violent animals and/or will immediately remove Client’s animal(s) from any animal fight.
5. Injure Or Escape Of Animals
Client and sitter are aware that the highest level of care shall be given to any and all pets under care of the pet sitter provided by PawPals Lake Nona LLC. Client is aware that pet(s) are instinctual in nature and not always controllable by the sitter even when the highest level of care is provided. Should the Client’s animal(s) run away or be injured, the Client agrees that PawPals Lake Nona LLC and any pet sitter will not be responsible for any liability. The above waiver of liability in favor of PawPals Lake Nona LLC not apply or be effective if PawPals Lake Nona LLC conduct in providing its pet care services is found to be grossly negligent, reckless, or if there is intentional misconduct.
6. Injury to Pet Sitter, another person or other animals by Client’s Animal(s)
Client will be responsible for all medical expenses and damages resulting from an injury to the pet sitter, other persons, or other animals by the Client’s pet(s). Client agrees to pay the full cost of any and all medical expenses and damages should they arise to the PawPals Lake Nona LLC sitter or the pet sitter’s possessions as a result of the Client’s animal(s) actions within 7 days of the initial incident. Client agrees to indemnify, hold harmless, and defend PawPals Lake Nona LLC and any pet sitter in the event of a claim by any person injured by the Client’s pet(s).
7. Owner’s Payment For Services
Owner will pay for all charges for all Services provided by PAWPALS or provided by others at the request of PAWPALS (collectively, the “Charges”). PAWPALS also reserves the right to require that Owner provides a deposit for any Services for an undetermined duration of time.
8. Solicitation of PawPals Lake Nona LLC Sitters
Client agrees that the pet sitter provided by PawPals Lake Nona LLC is employed by PawPals Lake Nona LLC and is to work only through PawPals Lake Nona LLC and not directly through the individual Client listed above. Client agrees that all reservations for present and future sitting and dog walking must be made through PawPals Lake Nona LLC and not the individual sitter. Client is aware that the PawPals Lake Nona LLC sitter may give out his/her personal number to the Client if there is an emergency. Client agrees to use this number only in the event of an emergency. Client agrees that this number shall not be used for any solicitation of future pet sitting or dog walking for a minimum of 2 years after the client terminates their relationship with PawPals Lake Nona LLC. Client is aware that should this contract be broken, legal fees and misuse-of-staff charges will apply.
9. Damage to Home
PawPals Lake Nona LLC is not responsible for any damage to the property or home of the Client unless such damage is caused by the negligent act of PawPals Lake Nona LLC or its providers. PawPals Lake Nona LLC is not liable for any loss or damage in the event of a burglary or other crime that should occur while under this contract. Client agrees to secure home prior to leaving the premises. PawPals Lake Nona LLC will re-secure the home to the best of its ability according to Client instructions at the end of each visit. PawPals Lake Nona LLC and its providers are also not responsible for damage to the property or home of the Client due to electrical problems, leaks, and acts of nature.
10. Off-leash Dog(s)
Some of our Clients request off-leash activity and play for their dog(s). Client is aware and agrees that the Client’s dog(s) may be off-leash only if the client has a secured fenced in yard or in designated dog parks. Dogs will only be taken to a dog park if other dogs are not present. PawPals Lake Nona LLC nor PawPals Lake Nona LLC walkers/sitters will be held liable for any damages resulting to people or other animals or to the Client’s dog(s). Client is responsible for pet-proofing house and yard and security fences/gates/latches. PawPals Lake Nona LLC will not be responsible for the safety of the pet(s) and will not be liable for the death, injury, disappearance or legal consequences of any pet(s) with unsupervised access to the outdoors.
11. Personal Property
I agree that PAWPALS shall not be responsible or liable for any lost, stolen, or damaged personal property belonging either to my dog or me.
12. Appointment Duration
Please note we may arrive up to 30 minutes before or after your scheduled appointment time.
13. Authorization to Enter Home
This signed document gives PawPals Lake Nona LLC and its providers authorization to enter the Client’s listed address as needed to perform the services as outlined in the service contract.
14. Video Cameras
Client agrees to refrain from placing video cameras in bathrooms and any room that the sitter may sleep in during overnight visits.
15. Inclement Weather
In the case of an emergency, inclement weather, or a natural disaster, the Client authorizes PawPals Lake Nona LLC and its providers to use reasonable judgment for the care and well-being of the Client’s pet(s) and house. PawPals Lake Nona LLC and its providers will make reasonable efforts to maintain service during these conditions, but reserves the right to adjust the schedule of service based on the sole discretion of the pet sitter.
In the event of rain during your dog’s scheduled walk, we can either:
- Walk your dog as scheduled if the rain is light. (We will not walk any dog if there is heavy rain, lightning, or thunder.)
- Credit your service to your account and reschedule for a new date within 6 months. Please note we do not offer refunds.
16. Photo/Video Release
Client authorizes PawPals Lake Nona LLC to use all photos and videos taken of their pets for promotional purposes.
17. Refusal of Services
PawPals Lake Nona LLC reserves the right to refuse service to any Client, at any time for any reason.
18. Client Concerns
Client agrees to notify PawPals Lake Nona LLC within 24 hours of their return of any concerns.
19. Refunds / Payment Process
All payments must be paid for BEFORE PawPals starts the first visit. If payment is not collected before the visit PawPals Lake Nona LLC will not provide services until done so. PawPals will NOT be refunding any services that are canceled once they are paid, but you will receive a credit to use for services in the future up to 6 months after canceled.
20. Duty to Disclose
a. I represent that my pet has not had any contagious illnesses of any kind including but not limited to rabies, distemper, parvovirus, upper respiratory infection for 30 days prior to the start of service date. I am aware and understand that PAWPALS Employees are not veterinarians and do not have backgrounds in animal medicine.
b. I represent that I have disclosed and shall continue to disclose, any and all medical conditions or any other conditions, including, but not limited to, any pre-existing illnesses, injuries, personality concerns or behaviors that may affect, limit, or prevent my pet’s ability to participate in services provided by PAWPALS.
c. I understand that PAWPALS is relying on and will rely on those representations to provide a safe environment for both humans and animals.
21. Miscellaneous.
This Agreement will be applicable to all Services provided by PAWPALS to the Pet at any location on or after the date of this Agreement.
Owner will pay all collection costs, including attorneys’ fees and court costs, regarding any Charges owed to PAWPALS that are not paid when due.
If any provision of this Agreement is held to be invalid or unenforceable, the remaining provisions of this Agreement will continue to be enforceable, to the fullest extent permitted by law or equity.
PAWPALS agrees to provide dog walking, drop in visits, private boarding services and other applicable pet care services in a reliable, caring and trustworthy manner. In consideration of the services and as an express condition thereof, the Owner expressly waives and releases PAWPALS from any and all claims against PAWPALS, its owners, employees and representatives, except those arising from negligence or willful misconduct on the part of PAWPALS.
PAWPALS reserves the right to terminate this contract at any time if the pet sitter/dog walker, in his/her sole discretion, determines that the Owner’s pet(s) poses a danger to the health or safety of itself, other pets, other people or the pet sitter/dog walker.
PAWPALS reserves the right to refuse service to any Owner/Client, at any time, for any reason.
This agreement gives PAWPALS and its representatives authorization to enter the Owner’s listed address as needed to perform agreed upon services.
PAWPALS is not liable for any loss or damage in the event of a burglary or other crime that should occur under this contract.
WAIVER AND RELEASE OF CLAIMS; AGREEMENT NOT TO SUE.
OWNER WAIVES AND RELEASES PAWPALS FROM ANY AND ALL CLAIMS, DEMANDS, CAUSES OF ACTIONS, ACTIONS, LAWSUITS, DAMAGES, JUDGMENTS, ATTORNEY’S FEES, COSTS, LIABILITIES, LOSSES, OR EXPENSES (COLLECTIVELY, “CLAIMS”).
This Agreement will be governed by the laws of the State of Florida, without any reference to principles or conflicts of laws.
